- 1.Every AI tool that touches client data has an executed BAA on file — not HIPAA-ready marketing (S5.4.1–5.4.2)
- 2.No staff member uses free or consumer chatbots with PHI — verified by policy and asked directly in supervision (S5.4.1)
- 3.Vendor's use of your data for model training is documented and disabled or excluded for PHI (S5.4.3)
- 4.AI tools sit inside normal access-control and device policies (S5.4.5)
- 5.A written policy names the approved tools, permitted document types, and permitted roles (S5.5.1)
- 6.Personal use of unapproved AI on client records is explicitly prohibited (S5.5.1)
- 7.Intake and consent language tells clients and caregivers, in plain words, that AI assists documentation (S5.5.2)
- 8.Payer or state disclosure requirements for AI-generated documentation are known and met, with evidence kept (S5.5.3)
